Affiliate Agreement

This Affiliate Agreement (referred to below as the “Affiliate” or “You” or “Your”) contains the complete terms and conditions between Boom Host (referred to below as “Boom Host” or “Our” or “Us” or “We”) and You, regarding Your application to and participation in, the Boom Host Affiliate Program (the “Affiliate Program”) as an affiliate of Boom Host, and the establishment of links from Your website to Our website or sub-domains at https://www.boomhost.com.

BY SUBMITTING AN APPLICATION TO JOIN OR BY PARTICIPATING IN THE AFFILIATE PROGRAM, YOU ARE CONFIRMING THAT YOU HAVE READ THIS AFFILIATE AGREEMENT AND THE BOOM HOST TERMS AND CONDITIONS LOCATED AT https://www.boomhost.com/terms-of-service.php AND THAT YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.

Joining the Affiliate Program:

By requesting Affiliate status from with Our Client Zone area (http://my.boomhost.com) or by submitting an application at http://my.boomhost.com You will automatically become a Boom Host affiliate. Your participation in the Affiliate Program is solely for this purpose: to legally advertise the Boom Host website and Our products to receive a commission on sales generated by Your referrals. You also agree to receive periodic emails from Us regarding the Affiliate Program. We may re-evaluate Your Affiliate Program status at any time.

Revocation of Affiliate Status:

Your Affiliate Application and status in the Affiliate Program may be suspended or terminated at Our sole discretion for any reason We deem fit, or for no reason at all. Some examples of behavior that may lead to a suspension or termination of Your account are:

a) Inappropriate advertisements (False claims, misleading hyperlinks)

b) Spamming (mass email, mass newsgroup posting, etc.)

c) Advertising on websites containing/promoting illegal activities

d) Violation of intellectual property rights.

Linking to Boom Host:

If You qualify and agree to participate as an Affiliate, We will make a variety of graphic and textual Affiliate Links available to You (each referred to herein as a “Affiliate Link” or collectively, as the “Affiliate Links”). The Affiliate Links will serve to identify Your website as a member of the Boom Host Affiliate Program and will establish a link from Your website or e-mail to Boom Host’s website. You agree to co-operate fully with Us in order to establish and maintain such Affiliate Links. You further agree that Your use of the Affiliate Links must be in compliance with this Agreement at all times. You may not refer Your own websites or refer Yourself to earn an Affiliate Commission. Boom Host may modify the Affiliate Links from time to time in its sole discretion. You will not use graphic or textual images (indicating a Link) or text messages to promote Boom Host that are not approved in advance by Boom Host. All Affiliate Sites shall display the Affiliate Links prominently in relevant sections of their website.

Affiliate Commissions:

Affiliate Commission Rate will be calculated based on the per product commission rates currently stated on the Boom Host Affiliate Program webpage https://www.boomhost.com/affiliate-program.php for each product purchased. Affiliate Commissions will be paid out via PayPal when You have reached the minimum payout amount designated by Our Affiliate Program. Withdrawal must be requested by opening a ticket from within Our Client Zone area -> Support Tickets -> Submit Ticket. There is a 90 day hold period on all affiliate commissions to catch and prevent fraud. If the referred product was refunded, the membership cancelled, or money was reimbursed, Boom Host reserves the right to deduct the appropriate commissions from the Affiliate’s account. Affiliate accounts which have been suspended or terminated may, at Our discretion, have some or all referrals invalidated and the account balanced adjusted accordingly. The Commission Rate is subject to change from time to time, upon e-mail notice to You and commencing the 30-days following such notice.

Affiliate Bonus Credit:

New signups or enrollment to Boom Host Affiliate Program shall receive a bonus credit as designated by Our Affiliate Program and this bonus credit shall give You a head start on Your profit earnings when advertising the Boom Host website and its Products. Bonus credit will not be redeemable until You have generated enough Commissions that is equal to greater than the minimum payout amount designated by Our Affiliate Program. Bonus credit may not be used to pay for any old or outstanding debts that You may have with Boom Host. Bonus credits may be revoked by Boom Host if deemed necessary.

Affiliate Tracking:

After signing up for the Affiliate Program You will receive a unique affiliate URL within the affiliate control panel which You will use to advertise Our website and products. When a web surfer clicks through this URL a cookie will be set in their browser with Your affiliate ID and their IP address will also be logged with Your affiliate ID. During that visit to Our website or any later visit within 90 days, when a purchase is made the commission will be given based on the existence of the cookie or a match of the IP address in the database.

Terms of the Affiliate Agreement:

The terms outlined in this agreement will begin upon Your signup with the Affiliate Program and will end when Your affiliate account is terminated by Us. The terms of this agreement may be modified by Us at any time. If any modification to the terms is unacceptable to You, Your only choice is to terminate Your Affiliate Program account. Your continuing participation in the program will constitute Your acceptance of any change.

Affiliate Program Liability:

Boom Host will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, and any results of “intents of harm” to the Affiliate Program or Our website(s). Boom Host does not make any expressed or implied warranties with respect to the Affiliate Program and/or products sold on Our website(s). Boom Host makes no claim that the operation of the Affiliate Program and Our website will be error-free and We will not be liable for any interruptions or errors.
